It’s interesting that the American Bar Association and the various State Bar Associations do not have a legal specialty for Indian Law.  The reason is that too few attorneys practice in this area.  Under the code of ethics, a lawyer can’t say they specialize in an area, unless they meet certain standards for education and experience, but there have never been any standards created.

As a result, Brian can only say that one of the focuses of his practice is Indian Law.  But he is one of the few attorneys in the country with this focus.

Indian law can be confusing to anyone not deeply involved in it because of many conflicting precedents, the issue of Sovereignty, and the sheer number of tribal courts and their individual standards.  The Law Office of Brian Utsey has the experience to guide you through the confusion and to help you find the best possible resolution to your case.

Brian earned his LL.M in Native American and Indigenous Peoples Law from the University of Tulsa in 2006.  While in school he held all the top offices, including President, in the Native American Law Students Association and was the groups’ National representative.

He was heavily involved in Cook v. Avi Casino - a landmark sovereign immunity case.  He also contributed to G William Rice's book "Cases on Indian Gaming Law" - THE textbook on Indian Gaming Law.

Brian Utsey was formerly the staff attorney and acting director of the Salt-River Pima-Maricopa Indian Community Legal Services office, and has been actively involved with the Boesche Legal Clinic Muscogee (Creek) Nation Indian Law Project.
